UPATE #2: Fatality Crash at FM 600; Case # 12-6648 (Press Release)

Today, officers with the Abilene Police Department (APD) arrested Eliseo Rey Garza (DOB: 10/05/94) for two counts of 2nd Degree Felony Intoxication Manslaughter in connection with the FM 600 crash that APD responded to in the early morning hours of April 15, 2012. As part of this investigation, blood samples from several involved persons, including the driver, were seized for evidentiary purposes. Toxicology results from the Texas Department of Public Safety were recently provided to APD and show that Mr. Garza’s blood alcohol concentration was 0.136. The statutory definition for intoxication is an alcohol concentration of 0.08 or more. This information was used in seeking an arrest warrant for Mr. Garza and is an indicator that he was intoxicated at the time of the crash. The initial findings and circumstances of this investigation remain the same. Mr. Garza was operating a motor vehicle on a public roadway that left the roadway with five other occupants inside. Two of those occupants are now deceased as a result of their injuries from the vehicle crash.

APD will finalize this investigation and file this case with the Jones County District Attorney’s office for their consideration of charges.
